Background & Outcome

No violation: The image itself is proper artistic statement. I am not satisfied that a reasonable reader will extrapolate from the "all caps" "FACT" a transformation of the content from opinion and rhetoric to factual statements. The content falls squarely within the artistic safe harbour of Section 16.
